Terms of Use
These Terms govern the relationship between ТОО Kaz Homestay (kazakhstanhomestay.com) (the "Agency"), the guest, and the host family within the homestay program.
1. Role of the Agency
The Agency acts as an intermediary between the guest and the host family: selecting a suitable family, organizing introductions, drafting the agreement, and mediating in case of disputes. The Agency is not liable for the personal actions of the parties during the stay, unless they are related to the terms of the agreement.
2. Payment
Long Stay (21 nights or more): A registration fee is paid online within 3 days of the host family being confirmed. Non-refundable. The remaining balance is paid in cash to the host family upon check-in.
Short Stay (less than 21 nights): A 30% deposit is paid online within 3 days of the host family being confirmed. Non-refundable. The remaining 70% is paid in cash to the host family upon check-in.
3. Non-Refundability
The registration fee and deposit are non-refundable under any circumstances, including visa denial, illness, change of plans, or other reasons. This compensates the time and costs of the agency and host family in preparing for the guest's arrival.
4. Early Departure
If you wish to leave before the agreed date, you must notify the agency in writing (by email) at least 1 month in advance. Otherwise, a penalty equivalent to 1 month's rent will be charged.
5. Change of Host Family
If, for objective reasons, the arrangement with a family does not work out, the agency will find a new family at no extra charge. The search may take several days — during this time the guest remains with the current family or in agreed temporary accommodation.
6. Property Damage
The guest compensates for any damage to the host family's property at market value. The condition of the room and belongings is recorded in an inventory report upon check-in and verified upon check-out.
7. Minimum Age
Independent accommodation is available from age 18. For guests under 18, written consent from a parent or legal guardian is required.
8. Electronic Confirmation
The parties agree to use a simple electronic signature (Article 7 of the RK Law "On Electronic Documents and Electronic Digital Signatures"). Agreement to the terms is expressed by a reply email containing the word "Agreed" combined with the online payment of the registration fee or deposit. Such a combination has the force of a handwritten signature.
9. Governing Law
These Terms are governed by the law of the Republic of Kazakhstan. Disputes shall be resolved in accordance with the procedure established by the legislation of the RK.
