Terms of Use
These Terms govern the relationship between ТОО Kaz Homestay (kazakhstanhomestay.com) (the "Platform"), the guest, and the host family within the homestay program.
1. Role of the Platform
The Platform provides the Guest exclusively with information and consulting services for matching accommodation options and a technological platform for information exchange. The Platform acts as an intermediary. All definitive arrangements regarding the stay, house rules, and code of conduct are explicitly fixed in a separate tripartite contract. The Platform is not liable for the personal actions, omissions, or behavior of the parties during the accommodation period.
2. Payment
Long Stay (21 nights or more): The registration fee is paid online within 3 days of the host family being confirmed. The remaining balance is paid directly to the host family upon check-in.
Short Stay (less than 21 nights): A 30% deposit is paid online within 3 days of the host family being confirmed. The remaining 70% is paid directly to the host family upon check-in.
The Registration Fee / Deposit constitutes payment for the Platform's actual expenses related to the services of searching, verifying, and securing the host family booking. This service is considered fully rendered at the exact moment the Platform sends the booking confirmation to the Guest.
3. Non-Refundability of Funds (Actual Expenses)
In accordance with Article 686 of the Civil Code of the Republic of Kazakhstan, the paid Registration Fee / Deposit is recognized by the Parties as a fixed sum covering the actual expenses already incurred by the Platform to process the application and hold the booking allocation. This payment compensates for the time and administrative costs of the Platform, and therefore is strictly non-refundable under any circumstances, including visa denial, illness, sudden changes in the Guest's plans, or any other personal reasons.
4. Limitation of Liability
Under no circumstances shall the total liability of the Platform to the Guest or the Host Family for any claims, damages, or lawsuits exceed the amount actually paid by the Guest to the Platform (i.e., the amount of the Registration Fee or Deposit).
5. Early Departure
If you wish to leave before the agreed date, you must notify the Platform in writing (via email) at least 1 month in advance. Otherwise, in accordance with the Offer Contract, a penalty equivalent to the cost of 3 months' stay will be charged.
6. Change of Host Family
If, for objective reasons, the arrangement with a family does not work out, the Platform will find a new family at no extra charge. The search may take several days — during this time the guest remains with the current family or in agreed temporary accommodation.
7. Property Damage
The guest shall compensate for any damage caused to the host family's property based on its fair market value.
8. Minimum Age
Independent accommodation is available from age 18. For guests under 18, written consent from a parent or legal guardian is required.
9. Electronic Confirmation
The parties agree that expressing consent to these Terms on the Website (by checking the checkbox) combined with the subsequent online payment of the registration fee or deposit carries full legal force. This action is recognized as an electronic confirmation and serves as a valid lawful basis for the subsequent signing of the main tripartite agreement.
10. Governing Law
These Terms are governed by the law of the Republic of Kazakhstan. Disputes shall be resolved in accordance with the procedure established by the legislation of the RK.
